Taylor Swift And Evermore Park Drop Lawsuits Against One Another
As we previously reported one month ago today, Taylor Swift’s intellectual property management company took legal action after a Utah fantasy theme park called Evermore filed a lawsuit against the artist. Variety reported that the matter has been resolved, with neither side receiving any monetary settlement in the agreement to set aside their respective claims.
The lawsuit Evermore filed against Swift earlier last month accused her of trademark infringement over the artist’s album of the same name and related merchandise. Additionally, they claimed Swift’s Evermore album caused “actual confusion” that affected the park’s online presence negatively, along with infringing on its marketing and merchandise.
Swift’s suit alleged that three of Swift’s songs “Love Story,” “You Belong With Me,” and “Bad Blood” were regularly used in performances at the park without a proper license. The suit stated along with allegedly using the three songs without proper licenses, Evermore repeatedly “blatently ignored” messages from BMI, the performance rights organization, regarding the matter. The claim states that the amusement park responded only after they learned a countersuit was imminent.
According to Swift’s camp, “As a resolution of both lawsuits, the parties will drop and dismiss their respective suits without monetary settlement.”
Per Variety, the theme park, which has “no rides and is closer to an immersive Renaissance Faire-type experience,” is currently closed, after having to cancel its planned winter season and lay off dozens of employees as a result of conditions imposed by the pandemic.
